Integrated advice on commercial property leases
Commercial leases cover a vast range of property types, and are drafted in many different forms. Our approach is simple: Whether you’re an owner or occupier, at each lease event we do everything possible to create and add value for you.
This may be by advising you to bring rents into line with the market, helping you to negotiate the right rent , or suggesting how to amend or fine tune specific sections of a lease agreement.
With a comprehensive regional presence and a pool of highly experienced and capable specialists, dedicated to the core industrial, office and retail sectors, we’re able to give you tailored advice at any stage of the property lifecycle.
We are equally at home working with the public sector as we are with the private, with a strong presence in both, and a solid understanding of the differences and synergies between the two.
Leases can be complex and, on occasion, contentious. Our rounded perspective of the issues involved in leasing property means that the advice we give is comprehensive, and grounded in commercial reality - we know the market on a local and a national level. This is complemented by our specialist knowledge of markets as diverse as data centres, education and healthcare.
Rent reviews are contractual obligations within a lease, which require careful, skilled negotiation. Our goal is to get the right result. We do this by providing advice, and then undertaking the subsequent negotiations.
We negotiate on your behalf to find a mutually beneficial agreement, but where necessary we also have experience in taking matters to arbitration and independent expert stage. In these instances we act as expert witnesses and provide you with specific advice and a strategy around the dispute resolution process.
We provide advice and support throughout the whole renewal process, guiding you from the initial stages, through the receipt of notices, to a successful outcome, including court proceedings where required.
Working closely with your solicitors, we will advise in respect of the whole Landlord and Tenant Act 1954, helping to secure the right rent and other lease terms.
Specifically, we will act as instructed in renewal discussions, for either landlord or tenant, to find the best outcome. If necessary we are qualified to take the matter to court or PACT and act as independent expert witnesses.
We are also able to provide advice where there is no security of tenure, outside of the act, or in Scotland where there is a different legal system.
Dilapidations/Section 18 claims
Dilapidations issues feature at every stage of a lease, from the consideration of liabilities when a new lease is agreed, to the enforcement of lease covenants during the term, break options, surrenders, end of term building works, and the negotiation of financial settlements.
While the focus is often on dilapidations at the end of a lease our experts frequently advise clients at the pre-lease stage, provide dilapidations liability budgeting advice during a lease, and deal with all interim dilapidations matters.
We can help you with these negotiations and guide you through what can be a complex and varied process, tailoring our services to suit your individual requirements, including the preparation of expert court reports regarding the limitation cap for dilapidations.
Strategic portfolio advice
Our national network of offices enables us to provide comprehensive and tailored lease advice on your property portfolio, whether existing or a potential portfolio.
This applies to both investors and commercial occupiers considering their future occupational needs.
Our strategic portfolio advice combines our expert knowledge with reporting technology to give a holistic overview. This has led to us acting for clients such as RBS and NHS Property Services on their national occupied estate, delivering savings and accurate reporting on lease events, so that they can concentrate on their core businesses.
Unlocking value for our clients is our key objective. To do this we mix market awareness with technical knowhow, helping both occupiers and landlords.
We also use our expansive knowledge of the rental and investment markets to strengthen our clients’ hands in negotiations.
By surrendering breaks or agreeing reversionary leases we assist with providing certainty of occupation for both landlords and tenants alike.
We are experienced in a wide range of market sectors, not just the traditional office, industrial and retail sectors.
We have specialists in the Leisure sector including restaurants, pubs, bars, bowling alleys, casinos, cinemas and hotels, as well as proficiency in the specialist Data Centre market and Education sector. We have also advised clients within the motor trade sector.
