Rent review
Rent reviews are contractual obligations within a lease, which require careful, skilled negotiation. Our goal is to get the right result. We do this by providing advice, and then undertaking the subsequent negotiations.
We negotiate on your behalf to find a mutually beneficial agreement, but where necessary we also have experience in taking matters to arbitration and independent expert stage. In these instances we act as expert witnesses and provide you with specific advice and a strategy around the dispute resolution process.
Lease renewal
We provide advice and support throughout the whole renewal process, guiding you from the initial stages, through the receipt of notices, to a successful outcome, including court proceedings where required.
Working closely with your solicitors, we will advise in respect of the whole Landlord and Tenant Act 1954, helping to secure the right rent and other lease terms.
Specifically, we will act as instructed in renewal discussions, for either landlord or tenant, to find the best outcome. If necessary we are qualified to take the matter to court or PACT and act as independent expert witnesses.
We are also able to provide advice where there is no security of tenure, outside of the act, or in Scotland where there is a different legal system.
Dilapidations/Section 18 claims
Dilapidations issues feature at every stage of a lease, from the consideration of liabilities when a new lease is agreed, to the enforcement of lease covenants during the term, break options, surrenders, end of term building works, and the negotiation of financial settlements.
While the focus is often on dilapidations at the end of a lease our experts frequently advise clients at the pre-lease stage, provide dilapidations liability budgeting advice during a lease, and deal with all interim dilapidations matters.
We can help you with these negotiations and guide you through what can be a complex and varied process, tailoring our services to suit your individual requirements, including the preparation of expert court reports regarding the limitation cap for dilapidations.
